Pogust Goodhead has filed an antitrust class action on behalf of direct purchasers of new replacement tires for passenger cars, vans, trucks and buses (“Tires”) in the United States.
Tires price fixing
The case alleges that the following tire manufacturers entered into an illegal price fixing agreement starting in 2020:
- Bridgestone
- Continental
- Goodyear
- Michelin
- Nokian
- Pirelli
The agreement was implemented through dramatic and coordinated lock-step price increases, resulting in skyrocketing prices for Tires sold in the United States.
This antitrust class action comes on the heels of an announcement by the European Commission that it had carried out dawn raids of several Tire manufacturers.
These surprise inspections were carried out due to concerns that the Tire manufacturers violated EU antitrust rules that prohibit cartels and restrictive business practices. The antitrust authorities are investigating whether these companies illegally coordinated prices, including via public communications. These types of “signaling” communications are often used by cartels to implement their illegal price-fixing agreements.
